This policy explains how AskAnkita collects, uses and protects personal data. It covers three groups of people: clients, the businesses that use our service; buyers, the people who comment on a client's Instagram reel or chat with the AskAnkita bot on WhatsApp or Instagram; and visitors to atomhq.in.
We wrote it with India's Digital Personal Data Protection Act, 2023 and the Information Technology Act, 2000 in mind. It is a plain-language summary of how the service works and what happens to your data.
01Who we are
AskAnkita is a WhatsApp bot that real estate developers in Ahmedabad, Gujarat, use to answer and qualify home buyers.
Buyers usually find us through a reel by Ankita Jani, a real estate creator on Instagram. The bot replies in her voice, and it always tells buyers it is AI.
02Who decides what
For client and website data, we decide why and how it is used. In the words of the law, we are the data fiduciary.
For buyer data, we act on behalf of the developer whose project you asked about. The developer decides what they need to know and what their team does with your enquiry; we run the bot and the dashboard for them. In the words of the law, the developer is the data fiduciary and we are its data processor.
Either way, you can bring any question or request to us. We will handle it, or pass it to the developer and tell you we have.
03Data from clients
When you sign up and use the service, we collect:
- Your name, email address and phone number.
- Business details, such as your company name and projects.
- Billing details, including your GSTIN if you choose to add it.
- Payment records, such as amounts, dates and status.
- How you use your account, such as logins and settings.
Payments are handled by Razorpay. We do not receive or store your full card details.
04Data from buyers
When you chat with the bot about a project, we collect:
- Your WhatsApp name and phone number.
- The messages you send, and the bot's replies.
- Your answers to the qualifying questions, such as budget, BHK, preferred area and move-in timing.
- A lead score out of 100, showing how well you fit the project.
- Any site visit you book, with the date and time you choose.
- If you start from Instagram, your Instagram username and account ID, the comment you posted, and the direct messages you exchange with us.
Please don't share bank, card or ID numbers in the chat. The bot never needs them.
05Data from Instagram and WhatsApp
Our app connects to Meta's Instagram API and WhatsApp Business Platform. A client connects their own Instagram professional account and WhatsApp number to us, and gives us permission to act for them.
Through Instagram, we receive only what we need to answer an enquiry:
- The connected account's ID, username and the IDs of its reels, so the client can choose which reel a campaign runs on.
- Comments on the client's own reels. We reply only to comments that contain the client's chosen keyword, with one public reply under the comment.
- Direct messages. We send one private reply to a person who commented that keyword, and answer their replies within the 24-hour window Instagram allows. We never message anyone who has not contacted the client first.
Through WhatsApp, we receive the messages you send to the client's WhatsApp number, your WhatsApp name and number, and delivery status.
We use this data only to answer your enquiry and pass it to the business you contacted. We do not sell it, use it for advertising, build profiles for anyone else, or share it with data brokers. We do not hide, delete or edit anyone's comments or posts.
06Website visitors
When you visit atomhq.in, our servers and hosting provider record basic technical data, such as your IP address, browser type, the pages requested and when. We use it to keep the site working and secure.
The site has no advertising trackers. We use analytics, which sets cookies, to understand in aggregate how the site is used, such as which pages people visit. A cookie also keeps clients logged in to the dashboard.
Ankita's reels are embedded from Instagram. When a reel loads, Instagram may collect data under Meta's own policies.
07How we use data
- To run the bot: reply to buyers, ask the qualifying questions, score leads and book site visits.
- To deliver qualified leads to the developer whose project you asked about.
- To send WhatsApp follow-ups to buyers who don't fit yet, on the Grow and Scale plans.
- To run client accounts, billing, invoices and support.
- To monitor and improve replies, and to keep the service secure.
- To meet our legal, tax and accounting duties.
We rely on your consent, which you give when you start a chat or sign up, and on uses the law allows without consent, such as keeping tax records.
We do not sell personal data to advertisers or data brokers. A buyer's details go only to the developer whose project they asked about.
08AI and lead scores
The bot's replies are generated by AI in Ankita's voice. Buyers are always told they are talking to AI. The persona the bot follows has been reviewed, and conversations are monitored.
To write each reply, the chat is sent to AI model providers that generate the text. They process it to produce replies for us.
The lead score is an automated estimate of how well your answers match a project. It helps the developer's team decide whom to call first. It is not a credit check, and it does not decide anything about you on its own.
10Storage, security and retention
We store data with cloud providers and protect it with reasonable security safeguards, such as access controls and keeping each client's data separate. Some providers may process data outside India, where the law permits it.
We keep data only as long as we need it for the purposes above. Buyer data is kept while the developer's plan is active and for a limited time after, unless you or the developer ask us to delete it sooner. Billing records are kept as long as tax law requires.
If a personal data breach happens, we will inform the people affected and the authorities, as the law requires.
11Your rights and choices
Under the DPDP Act, you can ask us to:
- Access a summary of the personal data we hold about you and how we use it.
- Correct, complete or update it.
- Erase it, where the law does not require us to keep it.
- Withdraw consent you gave, for the future.
- Nominate someone to act for you if you die or cannot act yourself.
- Raise a grievance about how your data is handled.
Buyers can stop at any time. Reply STOP in the chat, or block the number in WhatsApp, and we will stop all automated messages. Reply START to resume.
We may need to confirm who you are before acting on a request. For buyer data, we may involve the developer, since they decide how it is used.
12How to delete your data
You can have everything we hold about you erased, in any of these ways:
- Send DELETE MY DATA from the WhatsApp number or Instagram account you contacted us from. Every message, answer and lead record we hold for you is erased immediately, and anything still queued to send is cancelled. On WhatsApp we reply with a confirmation code.
- From Instagram: go to Settings → Apps and websites, remove AskAnkita, and request deletion of your data. Meta notifies us and we erase your data automatically. You receive a confirmation code and a link where you can check the status.
- By email: write to askankitaapi@gmail.com with the WhatsApp number or Instagram username you used. We will ask you to confirm from that account, so nobody else can erase your data.
Removing AskAnkita from your Instagram account without requesting deletion stops every automated message to you, but keeps your enquiry so the business can still answer it.
13Children
AskAnkita is not meant for anyone under 18. We do not knowingly collect data from children. If you think a child has chatted with the bot or signed up, tell us and we will delete their data.
14Changes to this policy
We may update this policy as the service changes. We will change the date at the top and, for significant changes, tell clients by email or in the dashboard.
15Contact and grievances
For questions, requests or grievances about personal data, email us at askankitaapi@gmail.com.
We will respond within the time the law requires. If you are not satisfied with our answer, you can complain to the Data Protection Board of India.
